👋 Introduction
Welcome to ColorFun Kids. These Terms of Service ("Terms") govern your use of the ColorFun Kids iOS application ("App") operated by the App developer ("we", "us", or "our").
By downloading or using the App, the parent or legal guardian ("you") agrees to be bound by these Terms on behalf of yourself and any child using the App under your supervision. If you do not agree, please do not use the App.
📱 License to Use
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple device you own or control, solely for your family's personal, non-commercial use.
You may not:
- Copy, modify, or create derivative works of the App
- Reverse-engineer, decompile, or disassemble any part of the App
- Use the App for any commercial purpose or on behalf of a third party
- Remove or alter any proprietary notices or labels on the App
- Use the App in any way that violates applicable laws or regulations
👨👩👧 Parental Responsibility
You are responsible for supervising your child's use of the App and for all activity that occurs under the child profiles created on your device. You agree to:
- Set up and safeguard the Parent Dashboard PIN to prevent unsupervised access to settings
- Review and approve any artwork your child wishes to share
- Configure age-appropriate daily time limits within the Parent Dashboard
- Ensure any artwork shared externally is appropriate and complies with the terms of the destination platform
💳 Subscriptions and In-App Purchases
Free features
The App is free to download and includes a selection of coloring pages and core drawing tools at no charge.
ColorFun Kids Premium
Additional coloring pages and features are available through a ColorFun Kids Premium subscription, offered in the following plans:
- Monthly — billed monthly, cancel any time
- Annual — billed once per year at a discounted rate
- Lifetime — one-time purchase, permanent access
Free trial
Subscription plans may include a free trial period. If a free trial is offered, you will not be charged until the trial period ends. If you do not cancel before the trial ends, the subscription will automatically renew at the standard price.
Billing and renewal
All purchases are processed by Apple through the App Store. Your Apple ID account will be charged at confirmation of purchase and at the start of each renewal period. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
How to cancel
You can manage or cancel your subscription at any time:
- Open the Settings app on your iPhone or iPad
- Tap your name at the top → Subscriptions
- Select ColorFun Kids and tap Cancel Subscription
Cancellation takes effect at the end of the current billing period. You will retain Premium access until that date.
Refunds
All purchases are final and non-refundable except as required by applicable law or Apple's own refund policy. To request a refund from Apple, visit reportaproblem.apple.com.
Price changes
We reserve the right to change subscription pricing. Apple will notify you of any price increase before your next renewal, and your continued subscription constitutes acceptance of the new price.
🖼️ User Content
Artwork created in the App ("User Content") belongs to you. We claim no ownership over drawings your child creates. We have no access to User Content — it is stored locally on your device only.
When you share artwork externally (via the iOS share sheet), you are responsible for ensuring the shared content is appropriate and complies with the terms of the platform you share it to.
🎨 Our Intellectual Property
The App, including all built-in coloring page artwork, illustrations, sounds, interface designs, and the ColorFun Kids name and logo, are owned by us and protected by copyright and other intellectual property laws. Your licence to use the App does not transfer any ownership of these materials to you.
🔄 Updates and Changes to the App
We may update the App from time to time to add features, fix bugs, or comply with legal requirements. Updates are delivered through the Apple App Store. We reserve the right to modify or discontinue any feature with or without notice, though we will try to communicate significant changes in advance.
⚠️ Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use the App at your own risk.
🛡️ Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the amount you paid for the App or a Premium subscription in the twelve (12) months preceding the claim.
🍎 Apple App Store Terms
These Terms are between you and us only, not Apple Inc. Apple has no obligation to provide maintenance or support for the App. To the extent any term conflicts with Apple's App Store terms, Apple's terms take precedence with respect to your use of the App Store.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
📍 Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer is located, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
📝 Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice within the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
