1. Acceptance of these terms
These Terms of Use ("Terms") are an agreement between you and Ghassan Jaam ("we", "us", "the developer") governing your use of the Mina app ("Mina", "the app") for iOS and iPadOS. By downloading, installing, or using Mina, you agree to these Terms. If you do not agree, please do not use the app.
2. License to use the app
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Mina on any Apple-branded device that you own or control, for your own personal, non-commercial enjoyment, as permitted by the App Store's usage rules.
This licence does not give you any ownership of the app itself, and you may not:
- Copy, modify, or create derivative works of the app
- Reverse-engineer, decompile, or disassemble the app, except where applicable law expressly permits it despite this restriction
- Rent, lease, lend, sell, redistribute, or sublicense the app
- Remove or obscure any copyright or other proprietary notice
3. Your towns and your content
Everything you build in Mina — your towns, their layout, and any thumbnails generated from them — is your own creative work and stays on your device (and, if you enable it, in your own iCloud account; see the Privacy Policy). We do not claim any ownership over the towns you build.
If you use the app's Share feature to export a photo or a 3D model of a town and post it somewhere public, that sharing is between you and wherever you post it — we are not involved and take no responsibility for how it's used once it leaves your device.
4. Acceptable use
Mina is offline, single-player, and has no way for one user to interact with another inside the app. In using it, you agree not to:
- Use the app in any way that violates applicable law
- Attempt to interfere with the app's normal operation, for example by exploiting a bug to damage another user's device or data
- Misrepresent your affiliation with us, or use the app's name, icon, or assets to imply an endorsement that doesn't exist
5. Our intellectual property
The Mina app — its name, icon, artwork, sounds, source code, and design — is owned by Ghassan Jaam and protected by copyright and other intellectual property laws. Nothing in these Terms transfers any of that ownership to you. Apple®, iPhone®, iPad®, iCloud®, and the App Store® are trademarks of Apple Inc.
6. No warranty
Mina is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of data loss — while towns are saved automatically, we recommend not treating the app as your only backup of something irreplaceable to you.
Nothing in this section limits any warranty that cannot be excluded or limited under applicable law, including statutory consumer-protection rights you may have where you live.
7. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, Mina — even if we have been advised of the possibility of such damages. Because Mina is a free app with no in-app purchases, our total liability to you under these Terms, to the extent it cannot be excluded, will not exceed the amount (if any) that you paid us for the app.
8. Apple and third-party terms
Mina is distributed through Apple's App Store and is subject to Apple's Standard End User License Agreement in addition to these Terms. Where the two conflict on a point Apple requires, Apple's terms control for that point. Apple is not a party to these Terms and has no obligation to provide support or maintenance for Mina. Apple is a third-party beneficiary of these Terms and may enforce them against you.
9. Termination
You may stop using Mina and delete it from your device at any time. We may suspend or discontinue the app, or any part of it, at any time — for example by removing it from the App Store — though we will try to give reasonable notice where practical. Sections 5, 6, 7, and 11 survive any termination of these Terms.
10. Changes to the app or these terms
We may update Mina from time to time, including adding, changing, or removing features. We may also update these Terms; if we do, we'll change the "Effective" date at the top of this page. Continuing to use the app after an update to these Terms means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws applicable in the developer's place of business, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your own country or region gives you rights these Terms cannot override — those rights are unaffected.
This clause is intentionally general. If you need a jurisdiction named explicitly here — for a specific storefront's legal requirements, for instance — that's a one-line edit to this page once you've decided which jurisdiction to specify.
