Terms of Service — PocketLLM

1. Acceptance of Terms

By downloading, installing, or using PocketLLM ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Ghassan Jaam ("Developer," "we," "us," or "our").

These Terms apply in addition to Apple's standard Licensed Application End User License Agreement (EULA), which is incorporated by reference.

2. License Grant

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use PocketLLM for your personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the Apple App Store terms.

You may not:

Use the App for any commercial purpose or for any public display (commercial or non-commercial) without prior written permission from the Developer.
Copy, modify, distribute, sell, or sublicense any part of the App.
Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law.
Remove or alter any proprietary notices or labels on the App.
Use the App to develop a competing product or service.

3. AI Output Disclaimer — No Warranty on Generated Content

PocketLLM runs open-weight AI language models that generate text in response to your prompts. AI-generated content may be inaccurate, incomplete, outdated, biased, or otherwise unreliable. The Developer makes no representations or warranties regarding the accuracy, reliability, completeness, or fitness for any particular purpose of any AI-generated output.

You are solely responsible for evaluating and verifying any content generated by the App before relying on it for any purpose, including but not limited to medical, legal, financial, safety-critical, or professional decisions. The App is not a substitute for professional advice.

Do not use AI outputs as the sole basis for decisions that could affect your health, safety, finances, legal rights, or the rights of others.

4. Third-Party AI Models & HuggingFace

PocketLLM enables you to download open-weight AI models from HuggingFace, a third-party platform. Each model is subject to its own license agreement (e.g., Meta's Llama license, Mistral's license, Apache 2.0, MIT, or others). By downloading and using a model, you agree to comply with that model's license terms.

The Developer does not host, modify, endorse, or warrant any third-party models. We are not responsible for the content generated by models you choose to download, nor for any legal consequences arising from your use of a model in violation of its license.

Use of HuggingFace's platform is additionally governed by HuggingFace's Terms of Service.

5. Subscriptions & In-App Purchases

PocketLLM may offer optional auto-renewing subscriptions and one-time in-app purchases to unlock premium features ("Premium").

Billing: Subscriptions are billed through your Apple ID account via the App Store. Payment will be charged to your Apple ID account at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate as the original purchase, unless the price has changed and you have been notified.
Free trials: If a free trial is offered, unused portions of a free trial are forfeited upon purchase of a subscription.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings: Settings > [your name] > Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until then.
Price changes: The Developer reserves the right to change subscription pricing. You will be notified of any price changes in advance and will have the opportunity to decline the new pricing before it takes effect.

6. Refund Policy

All purchases are final and non-refundable, except as required by applicable law or as expressly provided by Apple's refund policies. Because all transactions are processed by Apple, all refund requests must be directed to Apple:

Visit reportaproblem.apple.com to request a refund from Apple.
The Developer has no ability to issue refunds directly for App Store purchases.

If you are located in a jurisdiction where consumers have statutory rights to a refund (e.g., EU cooling-off period), those rights are not affected by these Terms, and Apple's processes will apply.

7. Acceptable Use

You agree not to use PocketLLM to:

Generate content that is illegal under applicable law, including content that infringes intellectual property rights or constitutes defamation, fraud, or harassment.
Generate, distribute, or promote content involving child sexual abuse material (CSAM) or the exploitation of minors in any form.
Create malware, phishing content, or other malicious code.
Attempt to circumvent any technical limitations of the App.
Violate any applicable local, national, or international law or regulation.

The Developer reserves the right to terminate your license if you violate these terms, to the extent we have the technical ability to do so (noting that the App operates primarily offline).

8. Intellectual Property

PocketLLM, including its design, code, graphics, and branding, is the intellectual property of Ghassan Jaam and is protected by applicable copyright and trademark laws. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license granted in Section 2.

AI-generated outputs produced by third-party models within the App may or may not be subject to copyright protection under applicable law. The Developer makes no claim of ownership over outputs generated by models you run.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOUR USE OF THE APP IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GHASSAN JAAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is resident, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, except where prohibited by applicable consumer protection law in your region.

12. Changes to These Terms

The Developer reserves the right to modify these Terms at any time. Material changes will be communicated via an update to the effective date and, where feasible, via an in-app notice. Your continued use of PocketLLM after such changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.
